Abstract

The monograph deals with a theoretical approach to the set of interpretative issues emerging from the discipline on remote control of the workers' activity amended by Legislative Decree no. 151/2015 and n. 185/2016. By means of rigorous, punctual and broad analysis compare the letter of the law, the orientation of the doctrine, of the jurisprudence and of the Privacy Guard and the notes of the Ministry of the Work, the author deepens the main thematic profiles of the subject. Reflection is divided into four parts: the definition of control from a technical and legal point of view; the examination of the obscure points of the new legislation; the usability of personal data of the worker collected by the employer; the screening of the consequences that the novel of 2015 has produced from the point of view of protection of the worker, even in relation to the law of supranational work and the phenomenon of digitization of work. The work consists in a valuable tool for scholars and provides an irreplaceable auxiliary to practitioners who are approaching the new regulatory framework.
