Abstract

The essay critically examines the jurisprudence that affirms the power of the criminal judge to verify the legiti- macy of the administrative act, even when the type of offence of which it is an element does not require it, highlighting that it expresses political-criminal choices extraneous to the constitutional principle of the judge subject only to the law.
