Abstract

The translation from French into Italian of the article by I. Vacarie, entitled "Transitions professionnelles et droits sociaux en droit positif français", allows the Italian-speaking reader to have access to the tools that the legislator provides on the matter, within the scope of climate of social transformation that characterizes the European Union and of the phenomenon of "modernization" of the labor market. First of all it concerns the difference that exists between the so-called rights. "performance" and the so-called. "social drawing rights", with particular regard to the holders, the content and objectives of the same. Subsequently we focus on the tendency of work "without adjectives" to approach the traditional subordinate employment relationship, as can be seen from the mention of the so-called. "work situations". Another important aspect is the relationship between "collective" and "individual", emerging from the development of capitalization, portability of drawing rights and the issue of financing. The final part is dedicated to a fundamental reflection on the general situation in which French labor law finds itself with respect to professional transitions and social withdrawal rights.
