Abstract

The Court of Cassation with this order confirms the presumption of responsibility pursuant to art. 2051 c.c. of the public body (custodian) for damages caused to the private in the use of state property. It also confirms that the defect of contradictory reasoning of the judgment is no longer configurable and the ap-peal in cassation law is admitted only for failure to examine a decisive fact that is the subject of discus-sion between the partie
