Abstract

The article concerns the order in which the Italian Court of Cassation raised the question of constitutional legitimacy of Article 2641 of the Civil Code insofar as it subjects to criminal forfeiture by equivalent value even the assets used to commit the crime, in relation to Articles 3, 27, first and third paragraphs, 42, and 117 of the Italian Constitution, the latter with reference to Article 1 of the First Additional Protocol to the ECHR, and Articles 11 and 117 of the Italian Constitution, with reference to Articles 17 and 49, paragraph 3, of the Charter of Fundamental Rights of the European Union.
