Abstract
The paper examines a series of old (and new) problems regarding the fate of the sale of animals affected by disease, both in terms of issues related to the prerequisites of warranty for defects, the lack of quality and the diversity of the item, and in relation to the consequences in the event that the disease falls within those indicated in the veterinary police regulations, addressing this latter issue in light of Regulation (EU) 2016/429 (also known as the Animal Health Law – AHL). Particular attention is also given to the peculiar hierarchy of sources established by Article 1496 of the Civil Code for the regulation of warranty for defects in the sale of animals and its relationship with consumer protection law.| File | Size | Format | |
