Abstract

The essay examines the origins and perspectives of administrative full jurisdiction in the light of Antonio Amorth’s thought. After reconstructing the normative evolution of the full jurisdiction in the administrative process and the consequent scholar interpretations, the paper focuses specifically on the limits of the replacement power of the judge and tries to demonstrate how Amorth’s theory has grasped almost a century in advance the very essence of the administrative full jurisdiction. It therefore offers some clarifications on the scope and extent of the procedural substitutive power.
