Abstract

The Regional Electoral Guarantee Board has imposed a fine and an additional penalty of forfeiture on the President of the Sardinia Region for failing to comply with the regulations regarding electoral expenses. This measure raises several questions concerning adherence to the principle of strict legality, particularly since the candidate for the Presidency of the Region is not among those specified by the rules allegedly violated. Given the significant severity of the imposed sanction, it must be contextualized within the broader supranational and constitutional principles that define the legality of penalties, which are now consistently applied in the jurisprudence of the Constitutional Court.
