Abstract

This essay is dedicated to analyzing the decline of the rule of law in the field of biopolitics and biolaw. Following an analysis of the relationship between the rule of law, the founding values of the European Union, and democracy, it provides an in-depth overview of the current situation in some important areas of the exercise of individual freedoms (abortion, new forms of parenthood, end-of-life choices) and highlights how the general decline of the rule of law that has occurred in some European countries in these areas seems to be part of a deeply illiberal political project that is developing globally.
