Abstract

The Court of Auditors is undergoing a progressive functional and organizational transformation. This process will necessarily also impact the actions of public administrations, the general interest, and therefore citizens' rights, given the close connection between the functions of the Court of Auditors, the effectiveness and correctness of administrative action, the pursuit of the public interest, and the realization of rights. This essay examines the proposed amendments that most impact these aspects and investigates their constitutional coherence. It also offers an initial reflection, to be developed in a subsequent and broader context, on the current regulatory framework, which forms the basis and justification for these proposals. This aims to identify the extent and how it is changing the categories of administrative action and to identify paths that will ensure their functionality and democratic nature.
