Abstract

The modernization of inheritance law – which does not tend to evolve in practice, as is the case with that of obligations and contracts – should follow three lines, closely and inevitably linked, inherent α) the reform of the neces¬sary succession, β) the introduction into the Italian legal system of the inher¬itance contract, γ) the revitalization of the will. In the absence of new legislation, it would be appropriate to raise awareness among people about drafting their will by notary deed, because many problems are solved or at least reduced, if only one considers the protection of elderly and/or frail testators, by using this form rather than the holographic one.
