Abstract

The generalized civic access, established through Legislative Decree 25 May 2016, n. 97, is grafted into a system of document accessibility that in previous decades has been dominated by the much more restrictive discipline of the access governed by the Law. 7 August 1990, n. 241. Since the new legislation does not repeal the previous one, but takes only part of the application field, the actua problem is to identify the respective areas of operation in an unambiguous manner. The article, therefore, following a reconstruction of the current legislative framework, identifies the elements that are useful for tracing this border line.
