Abstract

The note to the order in epigraph aims to examine the text, in order to verify the congruity of the decision of the Court of Cassation with the general principles of labor law. In order to achieve the objective, the author, after having reported the controversy that constitutes its object, analyzes in general the question of balance discharges or disclaimers mixed with renunciations. Subsequently, she focuses on the document in question and on the position taken by the judges of legitimacy in relation to the prevailing orientation in this regard.
