Abstract

Considering the regulatory path that led to the “impresa familiare” regulation and in the light of the doctrinal and jurisprudential orientations that have guided its application over the years, the contribution analyses the reasons that persuaded the sezioni unite of Corte di Cassazione to raise the question of constitutional legitimacy of Article 230-bis of the Italian Civil Code, noting certain inconsistencies in its interpretation in relation to the current legal system.
