Abstract

The issue of the form of non-donative gifts is a classic topic, the solution to which is apparently stabilised, but not without nuances. The restrictive approach to form panders to the autonomy of private individuals. The blurry boundary between donations and other liberal acts, however, still makes the weapon of a declaration of nullity for lack of form fearsome.
