Abstract

Starting from the affirmation of Product Oversight and Governance as a new model of preventive protection for policyholders, this paper aims to test the impact of the new regulatory strategy on the governance system of insurance undertakings and on the structure of supervision of the conduct of operators entrusted to the competent Authority. To this end, we have chosen to pay particular attention to the obligation of insurance undertakings to adopt a specific “Product oversight and governance policy” (breviter: “POG policy”) as this is a dense fulfillment of profiles of interest in the perspective of the chosen investigation. Since this obligation is not adequately highlighted by the insurance code, the investigation will focus mainly on the main features of IVASS Regulation no. 45 of 4th august 2020 on the insurance products’ oversight and governance.
