Abstract

The paper is based on the idea that, at present, not all the critical profiles of the institute have been clarified. Therefore, on the basis of the pertinent 'positive' data and the related excursus of jurisprudence, an attempt has been made to leverage the profiles of more peaceful sharing in order to better elucidate those that seem most in the shadows: especially with regard to the related burdens and the implications in the light of the principle of effectiveness of protection.
